Users are all persons who make use of the free or fee-based services of Netzmedien AG on the electronic platforms it maintains (e.g.):

and others (hereinafter "the websites")

By accessing the relevant websites and/or using the services offered in connection with the company databases (hereinafter referred to as DB), you declare that you have understood and accept the following terms of use and legal information in connection with the website used (and the elements contained therein). Users who do not agree with the following conditions must refrain from accessing these websites and their pages.

The entire content of the websites is protected by copyright and belongs exclusively and comprehensively to Netzmedien AG (in particular copyright and other rights), unless otherwise stated. All rights are reserved. The elements are freely usable for browsing purposes only. If elements are reproduced in whole or in part in any form - electronically or in writing - the express permission of Netzmedien AG is required.

If software and other data or content is downloaded or reproduced from the website, all property rights remain with Netzmedien AG. The complete or partial reproduction, transmission (electronically or by other means), modification or use of the website or its content for public or commercial purposes is prohibited without the prior written consent of Netzmedien AG. The prohibition also includes the use of the content on own websites.

"Netzwoche" and all other media brands and their corresponding logos are registered trademarks of Netzmedien AG. No part of the websites is designed in such a way as to grant a license or a right to use an image, a registered trademark or a logo. Downloading or copying elements of the websites does not transfer any rights to the user with regard to the software or the elements on the website. Netzmedien AG reserves all rights (in particular copyrights and trademark rights) with regard to all elements on the websites and will fully exercise all possibilities to enforce these rights.

Netzmedien AG is not the owner of all trademarks mentioned in the information and documents contained on its websites. In this respect, the provisions of the corresponding trademarks apply; the rights to third-party content remain with the respective author. All information is provided without guarantee.

Although Netzmedien AG has taken every care to ensure that the information on the website is accurate at the time of publication, neither Netzmedien AG nor its partners can give any explicit or implicit assurance or warranty (including to third parties) with regard to the accuracy, topicality, factual correctness, reliability or completeness of the information. Liability claims against Netzmedien AG relating to material or non-material damage caused by the use or non-use of the information provided or by the use of incorrect or incomplete information are fundamentally excluded. Netzmedien AG expressly reserves the right to change, supplement or delete parts of the pages or the entire offer without special notice or to cease publication temporarily or permanently. Evaluations, opinions and analyses reflect the assessment of the author(s) and do not necessarily represent the opinion of Netzmedien AG. Netzmedien AG accepts no responsibility for information provided by companies (including links) or for profiles in the company database or for other third-party content on the websites. For technical reasons, a complete and permanent review of the content is not possible or reasonable. Netzmedien AG only carries out random checks and removes content that violates the law, the rights of third parties or morality if it becomes aware of it. Netzmedien AG accepts no liability for losses or damage of any kind (including due to negligence) arising from access to its websites or their elements and links (or from the impossibility of accessing or using the website or its elements and links) to the extent permitted by law. This also applies to system-related failures, interruptions and malfunctions of the technical systems and the service as well as to disruptions in the quality of access to the services due to force majeure or due to events for which Netzmedien AG is not responsible, in particular due to the failure of communication networks. The opening of attachments is at the risk of the user. Netzmedien AG does not guarantee that the files are free of viruses or are not otherwise capable of causing damage to users' computers. Information published on the websites about projects does not constitute an invitation, offer or recommendation to participate in companies, to make investments or to conclude contracts.

The user warrants to Netzmedien AG that the content of his data in the company or event database is correct, that it complies with the law, that the rights of third parties are protected and that common decency is observed. Netzmedien AG reserves the right to remove entries whose accuracy is doubtful without prior notice and without any right to justification. The removal of entries does not give rise to any claim for damages against Netzmedien AG. Every customer is obliged not to misuse the service and the services on the websites, in particular:

• not to upload any content including software or other material that is protected by copyright, unless the user himself is the owner of the respective rights or has the consent of the rights holder to use it,
• not to upload any files that contain viruses or are otherwise capable of causing damage to the technological and logistical infrastructure of Netzmedien AG, its partners or the users,
• not to use the technological infrastructure of Netzmedien AG, its partner companies and the users for purposes other than those intended,
• not to use the database to threaten, harass or defame others or to violate the rights (including personal rights) of others,
• not to use the addresses entered in the company and event database to send advertising e-mails.

If a user has entered himself or his company in the company or event database by providing an e-mail address and password, he/she is responsible for their safekeeping and use. Netzmedien AG is not liable for any damage caused by misuse or loss of e-mail address or password.

Each user undertakes to indemnify Netzmedien AG against any liability and against all obligations, expenses and claims arising from damages due to entries made by the customer. If the indemnification is not provided or not provided properly, Netzmedien AG reserves the right to take recourse against the customer.

In our privacy policy,we provide information on which personal data we process in connection with our activities and operations, including our www.netzmedien.ch-Website. In particular, we provide information on why, how and where we process which personal data. We also provide information about the rights of persons whose data we process.

By making an entry in the company or event database of the company directory and event, the user agrees that Netzmedien AG may publish the corresponding key figures entered in the database in its publications and use them to create rankings and other compilations. Netzmedien AG accepts no liability for the publication of incomplete, out-of-date or incorrect data.

Should parts of these provisions be or become invalid, this shall not affect the validity of the remaining provisions. Swiss law shall apply exclusively. For any disputes between Netzmedien AG and users, the registered office of Netzmedien AG shall be the exclusive place of jurisdiction.
